1. Introduction

Welcome to Realm33.org (the “Website” or the “Archive”). These Terms of Service (“Terms”) govern your access to and use of the Archive, which serves as a repository for information related to conspiracies, companies, individuals, myths, artifacts, and similar topics, as well as a showcase for our ongoing Simulation Project.

By accessing or using the Archive, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules posted on the Archive. If you do not agree to these Terms, you must not access or use the Archive.

We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on the Archive with a revised effective date. Your continued use of the Archive after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

If you are using the Archive on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Archive. By using the Archive, you represent and warrant that you meet this eligibility requirement. We do not knowingly collect information from or direct the Archive to children under 13, or under 16 in certain jurisdictions, as outlined in our Privacy Policy.

3. User Accounts and Registration

Currently, the Archive does not require user registration or accounts. However, if we introduce such features in the future, for example for commenting, contributing to the Archive, or accessing Simulation Project betas, the following will apply:

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • You agree to notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our discretion, without notice, for violations of these Terms.

4. Content and Intellectual Property

4.1 Our Content

All content on the Archive, including text, images, graphics, videos, software, and other materials related to the Archive, such as information on conspiracies, myths, and artifacts, and the Simulation Project, such as concept art and progress updates, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

You may access and view the content for personal, non-commercial use only. You may not copy, reproduce, modify, distribute, display, perform, or create derivative works from any content without our prior written consent, except as permitted by fair use or similar doctrines under applicable law.

4.2 User-Generated Content

If we enable features allowing you to submit content, such as comments, suggestions, or contributions to the Archive, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Archive and our services.

You represent and warrant that any content you submit:

  • Is original to you or you have the necessary rights to submit it.
  • Does not infringe third-party rights, such as copyright or privacy.
  • Is not defamatory, obscene, harmful, or illegal.

We are not responsible for user-generated content and may remove it at any time without notice.

4.3 Trademarks

“Realm33.org” and any associated logos are our trademarks. You may not use them without our permission.

5. User Conduct and Prohibitions

You agree to use the Archive only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Archive in any way that violates applicable laws or regulations.
  • Post, upload, or transmit any content that is harmful, threatening, abusive, defamatory, obscene, invasive of privacy, or promotes hate, violence, or discrimination.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Interfere with the Archive’s operation, including hacking, introducing viruses, or overloading servers.
  • Scrape, crawl, or use automated means to extract data without permission.
  • Use the Archive for commercial purposes without our consent.
  • Encourage or enable others to violate these Terms.

We reserve the right to monitor usage and take action against violations, including terminating access.

6. Disclaimers

The Archive and its content are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, non-infringement, merchantability, or fitness for a particular purpose.

We do not guarantee that the Archive will be error-free, secure, or uninterrupted. Access to the Archive may be modified, suspended, or discontinued at any time without notice. The information in the Archive, such as material on conspiracies and myths, is for informational and entertainment purposes only and should not be relied upon as factual or professional advice. We disclaim any liability for actions taken based on the content.

All information relating to the Simulation Project is preliminary and subject to change; we make no guarantees about development timelines, features, or release.

7. Limitation of Liability

To the fullest extent permitted by law, we, our affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the Archive, even if advised of the possibility of such damages.

Our total liability for any claim shall not exceed the amount you paid us, if any, in the preceding 12 months. Some jurisdictions do not allow limitations on liability, so these may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless us, our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from:

  • Your use of the Archive.
  • Your violation of these Terms.
  • Your infringement of third-party rights.
  • Any content you submit.

9. Termination

We may terminate or suspend your access to the Archive at any time, without notice or liability, for any reason, including if we believe you have violated these Terms.

Upon termination, your right to use the Archive ceases, but provisions that should survive, such as intellectual property, disclaimers, indemnification, and limitation of liability, will remain in effect. Termination of access does not automatically result in deletion of data, which will be retained or removed in accordance with our Privacy Policy.

10. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Iceland, without regard to conflict of laws principles.

Any disputes arising from these Terms or your use of the Archive shall be resolved exclusively in the courts of Iceland. You waive any objections to venue or jurisdiction.

We may seek injunctive relief in any court for intellectual property infringements or violations of these Terms.

11. Miscellaneous

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.

Waiver: Our failure to enforce any right does not constitute a waiver.

Entire Agreement: These Terms, together with our Privacy Policy and any other agreements, constitute the entire understanding between you and us.

Assignment: We may assign these Terms without your consent; you may not assign without our written consent.

Force Majeure: We are not liable for delays or failures due to events beyond our control, such as natural disasters, wars, or other extraordinary events.
